On January 13, 2014, Judge Jesus G. Bernal approved a settlement in a class action against Farmers Insurance. Caddell & Chapman represented a class of Farmers insureds in Arizona who suffered losses in excess of their policy limits. The suit alleges that Farmers improperly subtracted deductibles from payments to these insureds because the covered losses exceeded the applicable coverage limit in the policy (including sub limits, if the deductible applied to losses under that sub limit, and additional coverage limits, if the deductible applied to the additional coverage at issue). Under the settlement, class members who submitted claims in excess of their policy limits from March 2007-March 2013 will receive compensation for 100% of the underpayment plus interest. The claims period for this settlement is now closed. The case is Rodriguez v. Farmers Insurance Co. of Arizona et al., No. 09-cv-06786 (C.D. Cal.).
